The Georgia Department of Banking and Finance (Department) is the state agency that regulates and examines Georgia state-chartered banks, state-chartered credit unions, and state-chartered trust companies. The Department also has responsibility for the supervision, regulation, and examination of bank holding companies and Merchant Acquirer Limited Purpose Banks (MALPBs) chartered in Georgia.  In addition, the Department has regulatory and licensing authority over mortgage brokers, mortgage lenders, mortgage processors, mortgage loan originators, check cashers, sellers/issuers of payment instruments, money transmitters, consumer installment lenders, and international banking organizations, conducting business in Georgia.

 

Financial Institutions and financial service providers are subject to strong statutory and regulatory requirements at both the federal and state levels. We share regulatory responsibility for Georgia state-chartered financial institutions with our federal counterparts (FDIC, FRB, NCUA). For activities taking place within Georgia, we are the sole regulatory agency for mortgage lenders, mortgage brokers, consumer installment lenders, and money service businesses, which includes sellers/issuers of payment instruments, money transmitters, and check cashers (with the exception of the CFPB, which enforces federal consumer financial laws, and FinCEN and the IRS, which supervise the Bank Secrecy Act, USA PATRIOT Act and other Anti-Money-Laundering efforts).

Job Title:  Staff Attorney

Job Summary: 

Under broad supervision, provides analysis and/or recommendations on legal issues within the scope and authority of the agency. Acts as a liaison or representative between the agency and Department of Law.

Primary Duties & Responsibilities: 

  • Performs job responsibilities with minimal supervision
  • May supervise and/or direct the work of others
  • Provides analysis, answers, or recommendations regarding legal, liability, and/or risk-management issues
  • Drafts amendments to existing contracts, standardized letters, and notices related to administrative legal procedures
  • Develops, oversees, and implements administrative processes designed to maintain and monitor the legal compliance of department processes
  • Identifies and resolves, or assists in the resolution of, legal issues
  • Acts as a resource to answer questions and evaluates the status of collections 
  • Coordinates and implements due process procedures and procedures for appeals
  • Participates in the implementation of settlements, agreements, and/or legal judgments within approved guidelines
  • Participates in the preparation and coordination of cases prior to and during court trials and administrative hearings
  • Provides legal services such as writing articles and drafting new or amended legislation or regulations
  • Provides research and analysis of legal and policy issues
  • Provides training for other staff
  • Represents agency in administrative hearings or as a client to the Department of Law
  • Researches and analyzes current statutory and case law affecting the agency and/or programs

Entry Qualifications: 

Juris Doctorate from an accredited college or university AND license to practice law in the State of Georgia OR eligibility to sit for the next Georgia Bar examination OR reciprocity AND Two years of relevant legal experience OR Two years of experience required at the lower level Attorney 2 (LEP021).

Preferred Qualifications: 

License to practice law in the State of Georgia
