SUMMARY:
Responsible for oversight and coordination of all ongoing activity related to the development, implementation and maintenance of DHHS policies and procedures covering the privacy of, and access to, patient health information in compliance with federal and state laws and the healthcare organization’s information privacy practices.
YOUR EXPERIENCE COUNTS: Each additional year of approved formal education may be substituted for one year of required work experience and/or each additional year of approved work experience may be substituted for one year of required formal education.
MINIMUM QUALIFICATIONS:
EDUCATION: JD from a recognized law school.
EXPERIENCE: Six years of experience in the practice of law, health administration or management, health information privacy or health records management. Each additional year of approved work experience may be substituted for one year of required formal education at the graduate level only.
LICENSE/CERTIFICATION: Valid driver’s license and/or access to transportation for statewide travel
SPECIAL QUALIFICATIONS: Must be an active member of the New Hampshire Bar Association and in Good Standing prior to the start of employment.
SPECIAL REQUIREMENTS: Knowledge and experience in information privacy laws, access and release of information. In-depth knowledge of HIPAA Privacy and Security law and standards.
RESPONSIBILITIES:
- Provide development guidance and assist in the identification, implementation and maintenance of the organization’s information privacy policies and procedures in coordination with Department management and administration, the Chief Legal Officer and Chief Legal Counsel.
- Establish and monitor a mechanism to track access to protected health information, within the purview of the organization and as required by law, and a process to allow qualified individuals to review or receive a report on such activity.
- Work cooperatively with DHHS units in overseeing patient rights to inspect, amend and restrict access to protected health information when appropriate.
- Ensure application of sanctions for failure to comply with privacy policies for all individuals in the organization’s workforce, extended workforce, and for all business associates, in cooperation with Human Resources, the Security Officer, and administration.
- Maintain current knowledge of applicable federal and state privacy laws and accreditation standards to ensure organizational adaptation and compliance. Cooperate with the Office of Civil Rights, other legal entities, and organizational officers in any compliance reviews or investigations.
- Serve as information privacy consultant to DHHS for all departments and appropriate entities. Work with organization administration and other related parties to represent the organization’s information privacy interests with external parties (state or local government bodies) who undertake to adopt or amend privacy regulations, legislation or standards.
